1. Acceptance of Terms

These Terms of Service (“Terms”) form a legally binding contract between you (“User,” “you,” or “your”) and Soft Focus (“we,” “our,” or “us”). By accessing, browsing, or interacting with Soft Focus (located at softfocus.app and associated subdomains), you verify that you have read, understood, and agreed to adhere to these Terms and our accompanying Privacy Policy.

If you do not agree to every clause within these Terms, you must immediately cease accessing and using the platform.

2. Description of the Service

Soft Focus provides an aesthetic, mindfulness-oriented focus timer equipped with:

• Thematic focus environments (“Worlds”) featuring curated ambient visuals and motion.
• Continuous 3D zero-gravity levitation and interactive glassmorphic timer interfaces.
• Streaming ambient soundscapes and background audio integrated through compliant video player APIs.
• Local and cloud-synchronized milestone progression, session statistics, and streak achievements.
• Customizable playlists and session duration options.

The service is offered on an “as is” and “as available” basis. We reserve the discretion to refine, update, alter, or decommission specific worlds, audio streams, or functionality at any time without prior liability.

3. User Accounts & Guest Access

Guest Mode: You may explore worlds and utilize the focus timer without creating an account. In Guest Mode, all session metrics and unlocked milestone badges reside locally within your browser’s cache. We bear no liability for metric loss stemming from cache clearing or device changes.

Registered Accounts: To enable cross-device synchronization, you may register using supported third-party single sign-on (such as Google OAuth) or verified email authentication. You agree to provide accurate credentials and are solely responsible for maintaining the confidentiality of your account credentials. You must notify us promptly if you discover unauthorized access to your account.

4. Intellectual Property Rights

Soft Focus Materials: The Soft Focus name, leaf icon branding (“🌿 Soft Focus”), proprietary algorithms, glassmorphism design tokens, CSS animation implementations, milestone badges, and software architecture are the exclusive intellectual property of Soft Focus and protected under applicable copyright, trademark, and trade secret laws.

Third-Party Soundscapes & Artwork: Ambient tracks are accessed and streamed directly via the official YouTube IFrame Embed API in accordance with YouTube’s Developer Terms of Service. Soft Focus claims no ownership of third-party musical compositions, recordings, or third-party background photography. All copyrights remain with their respective artists and copyright proprietors.

5. Acceptable Use & Platform Restrictions

When using Soft Focus, you expressly agree that you will not:

• Reverse engineer, decompile, disassemble, or derive the source code of our backend or client architectures.
• Deploy automated scripts, scrapers, crawlers, or bots to flood our servers, manipulate user leaderboards, or siphon audio assets.
• Circumvent, disable, or tamper with security measures, authentication tokens, or rate-limiting protocols.
• Use the service to transmit malware, viruses, or disruptive code designed to damage user hardware or infrastructure.
• Attempt to harvest personal email addresses or confidential user profile records.

6. Voluntary Contributions & Tips

Soft Focus offers an optional “Support Soft Focus” tipping feature processed through Razorpay. You acknowledge that:

• Any donation or tip provided is purely voluntary and serves as gratitude to keep this independent space ad-free and assist in ongoing server and soundscape curation costs.
• Contributions do not grant ownership equity, shares, voting rights, commercial licensing privileges, or guarantees of future feature releases.
• All tips and donations are final and non-refundable once processed by the third-party payment gateway, except where mandatory consumer protection laws dictate otherwise.

7. Mindfulness Disclaimer & Limitation of Liability

Soft Focus is designed solely as an ergonomic lifestyle companion to promote focused study and calm work sessions. Soft Focus does not provide medical, psychological, psychiatric, or diagnostic advice. Our timer soundscapes and breathing prompts are not a substitute for professional clinical medical care or mental health treatment.

To the maximum extent permitted by applicable law, Soft Focus, its creators, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages—including loss of profits, data corruption, or operational interruptions—arising from your use or inability to use the platform.

8. Termination of Access

You are free to discontinue using Soft Focus at any moment. We reserve the unilateral right to suspend or terminate accounts, restrict platform access, or block network addresses without prior notice if we detect behavior violating these Terms, engaging in fraudulent activity, or threatening server stability.

9. Governing Law & Severability

These Terms shall be interpreted and governed in accordance with applicable laws, excluding conflict-of-law principles. If any individual provision within these Terms is adjudicated to be unlawful, invalid, or unenforceable, that specific clause shall be deemed severable and shall not impair the validity or enforceability of any remaining provisions.

10. Modifications to Terms & Inquiries

We reserve the right to revise these Terms whenever necessary. Revisions become effective immediately upon posting to this URL. Your continued usage of Soft Focus following published updates constitutes your agreement to the modified Terms.
